Ohio is an equitable division state. Every asset included in your and your spouse’s marital property is subject to division. Marital property is nearly anything purchased or earned by you and/or your spouse during your marriage. This may include your home, cars, bank accounts and investments. Even if only one spouse earned an income during the marriage, the other spouse earns an equitable share through his or her contributions to the household. Debts may also be subject to division.
One common controversy in a divorce is whether certain valuables are marital property or separate property. In general, separate property is anything one spouse owns solely, brought into the marriage and never allowed to become commingled with marital property. Generally, each spouse is able to retain their separate property. The landmark 2015 U.S. Supreme Court decision in Obergefell v. Hodges made same-sex marriage legal throughout the country.
