Child Support

Both parents have a legal duty to financially support their child. Whether you expect to pay or receive child support, it is critical that the amount is fair and sufficient to meet your child's needs. At Massucci Law Group, we will be strong advocates to ensure your child receives the appropriate financial support required for a healthy and happy upbringing. In cases where parents cannot agree, our attorneys will guide you through each step of the the process and work hard to ensure that the amount received or paid is appropriate.

Understanding Child Support

In Ohio, child support orders are based on established statewide guidelines focused on the financial circumstances of both parents. The primary factors used to calculate child support are the number of children and combined gross annual income of the parties. While the amount calculated by the guidelines is usually presumed to be appropriate, special circumstances including such issues as daycare costs, other children in a parent’s custody, health insurance costs, educational costs, and other extraordinary costs, may warrant a deviation. In cases when parents have income above $150,000 a year, child support is determined on a case-by-case basis.

Child support may seem somewhat mechanical and not much more than "filling in the boxes" in the guideline worksheets. However, determining the appropriate income to be included in the calculations can be challenging, especially if one parent is self-employed, unemployed or underemployed, and the court must impute income to that parent. Also, parties may disagree about the reasonable amount of child care or health care expenses. In all disputed cases, parties will need to introduce sufficient evidence to support their claims regarding income and expenses allowed in the established guidelines.
