Legal Separation and Annulment

Ohio law allows parties to obtain a legal separation prior to, or as an alternative to, divorce. Although a legal separation is similar to a divorce, the parties remain legally married, but live separately. The parties may agree to, or the court may order, division of property and financial support. If children are involved, the custody, parenting time, and support arrangements are also included in the legal separation. A legal separation may later be turned into a divorce by motion of either party.

Annulment

Unlike dissolution or divorce, which terminate valid marriages, annulment ends a marriage that was never legally valid. While Ohio law does not allow a marriage to be annulled simply because you were not married very long, common grounds for annulment include lack of capacity to marry, fraud, duress, an underage spouse, criminal conviction precluding marriage, failure to consummate the marriage, and bigamy. To obtain an annulment, you must meet strict guidelines and, as a result, only a small number of marriages qualify.
